A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the distribution to school districts of certain excess |
|
|
funds appropriated for the Foundation School Program. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 48, Education Code, is |
|
|
amended by adding Section 48.282 to read as follows: |
|
|
Sec. 48.282. DISTRIBUTION OF EXCESS FUNDS. Notwithstanding |
|
|
any other provision of law, not later than September 1 of any year |
|
|
following a school year in which the commissioner determines that |
|
|
the amount appropriated for purposes of the Foundation School |
|
|
Program exceeded the amount to which school districts were entitled |
|
|
under this chapter, the commissioner shall: |
|
|
(1) notify the Legislative Budget Board of the excess |
|
|
funds; and |
|
|
(2) distribute the excess funds, less the amount |
|
|
required to comply with Section 48.265, as determined by the |
|
|
commissioner, to each school district in an equal amount per |
|
|
student in weighted average daily attendance for the previous |
|
|
school year. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
