A BILL TO BE ENTITLED

AN ACT
|

|
relating to the application of a municipal building code to the |
|
|
construction of a solar pergola. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter G, Chapter 214, Local Government |
|
|
Code, is amended by adding Section 214.221 to read as follows: |
|
|
Sec. 214.221. REGULATION OF SOLAR PERGOLAS. A municipality |
|
|
may not apply a municipal building code to the construction of a |
|
|
solar pergola. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to the construction of a solar pergola on or after the effective |
|
|
date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
