A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to restrictions on candidacy in the general election. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 162.015, Election Code, |
|
|
is amended to read as follows: |
|
|
Sec. 162.015. RESTRICTIONS ON CANDIDACY IN GENERAL ELECTION |
|
|
[BY CANDIDATE OR VOTER IN PRIMARY]. |
|
|
SECTION 2. Section 162.015, Election Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) A person who was considered for nomination as a |
|
|
replacement candidate under Section 145.036 but did not receive a |
|
|
favorable vote of a majority of the voting members of the state, |
|
|
district, county, or precinct executive committee, as appropriate |
|
|
for the particular office, is ineligible for a place on the list of |
|
|
write-in candidates for the succeeding general election for state |
|
|
and county officers as a write-in candidate for the office sought by |
|
|
that candidate. |

|
SECTION 3. This Act takes effect September 1, 2023. |
