A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to participation in the wholesale electric market by a |
|
|
municipally owned utility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 552, Local Government |
|
|
Code, is amended by adding Section 552.9061 to read as follows: |
|
|
Sec. 552.9061. PARTICIPATION IN WHOLESALE ELECTRIC MARKET. |
|
|
Notwithstanding any other law, a municipally owned utility may not |
|
|
sell electric energy at wholesale if the utility has, during the |
|
|
preceding five municipal fiscal years, earned less revenue from |
|
|
wholesale sales in the electricity market than the utility has |
|
|
spent. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a municipal fiscal year that begins on or after the effective |
|
|
date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
