A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to enforceability of municipal prohibitions of outdoor |
|
signs in the municipality's extraterritorial jurisdiction. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 216.902, Local Government Code, is |
|
amended by adding Subsections (d) and (e) to read as follows: |
|
(d) Except as provided by Subsection (e), a municipality |
|
that extends its outdoor sign ordinance within its extraterritorial |
|
jurisdiction may not enforce a prohibition on an outdoor sign in the |
|
extraterritorial jurisdiction: |
|
(1) unless the municipality adopts the ordinance |
|
before the sign is placed; and |
|
(2) until the municipality annexes in accordance with |
|
Chapter 43 the property on which the sign is placed. |
|
(e) Subsection (d) does not apply to an area in a |
|
municipality's extraterritorial jurisdiction that: |
|
(1) is located within five miles of a military base; or |
|
(2) is located in a county: |
|
(A) located in the hill country viticultural |
|
area; |
|
(B) with a population greater than 240,000; and |
|
(C) that includes the Blanco River. |
|
SECTION 2. This Act takes effect September 1, 2023. |
