A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to Medicaid coverage and reimbursement for certain |
|
cancer-related treatments or items. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|
is amended by adding Section 32.0427 to read as follows: |
|
Sec. 32.0427. REIMBURSEMENT FOR CERTAIN CANCER-RELATED |
|
TREATMENTS OR ITEMS. The commission shall ensure that medical |
|
assistance reimbursement is provided to a health care provider for |
|
providing the following treatments or items in relation to cancer |
|
treatment: |
|
(1) physical therapy; |
|
(2) dental services related to the effects of |
|
chemotherapy or radiation, including: |
|
(A) oral surgery; |
|
(B) dental implants; |
|
(C) dental veneers; and |
|
(D) dentures; |
|
(3) compression garments, including: |
|
(A) sleeves; |
|
(B) garners; and |
|
(C) gauntlets; and |
|
(4) mastectomy products, including: |
|
(A) shells; |
|
(B) shapers; and |
|
(C) prostheses. |
|
SECTION 2. If before implementing any provision of this Act |
|
a state agency determines that any other waiver or authorization |
|
from a federal agency is necessary for implementation of that |
|
provision, the agency affected by the provision shall request the |
|
waiver or authorization and may delay implementing that provision |
|
until the waiver or authorization is granted. |
|
SECTION 3. This Act takes effect September 1, 2023. |
