A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the capture or use of a biometric identifier. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 503.001, Business & Commerce Code, is |
|
|
amended by adding Subsection (f) to read as follows: |
|
|
(f) (1) A state or local government, including a school, its |
|
|
contractor, subcontractor, or agents that captures a biometric |
|
|
identifier for the purpose of preventing safety or security |
|
|
concerns, theft, or other illegal activity may not sell the |
|
|
biometric identifier to a third-party. |
|
|
(2) This section shall not be construed to prohibit a |
|
|
State or local government agency, including a school, or its |
|
|
contractors, subcontractors, or agents from capturing biometric |
|
|
identifiers for the purpose of preventing, detecting, or responding |
|
|
to safety or security incidents, theft, or other illegal activity. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
