A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of an emergency services district to
  determine whether other persons may provide emergency services in
  the district.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 775.031, Health and Safety Code, is
  amended by adding Subsection (f) to read as follows:
         (f)  Except as provided by Subchapter B and Section 775.032,
  a district has the exclusive authority to determine whether another
  person may provide services in the district that the district is
  authorized to provide, including when the district's territory
  overlaps with the territory of another political subdivision
  authorized to provide services that the district is authorized to
  provide.
         SECTION 2.  The change in law made by this Act applies only
  to services provided under a contract entered into on or after the
  effective date of this Act. Services provided under a contract
  entered into before the effective date of this Act are governed by
  the law in effect on the date the contract was entered into, and the
  former law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2023.
