A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of an emergency services district to |
|
determine whether other persons may provide emergency services in |
|
the district. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 775.031, Health and Safety Code, is |
|
amended by adding Subsection (f) to read as follows: |
|
(f) Except as provided by Subchapter B and Section 775.032, |
|
a district has the exclusive authority to determine whether another |
|
person may provide services in the district that the district is |
|
authorized to provide, including when the district's territory |
|
overlaps with the territory of another political subdivision |
|
authorized to provide services that the district is authorized to |
|
provide. |
|
SECTION 2. The change in law made by this Act applies only |
|
to services provided under a contract entered into on or after the |
|
effective date of this Act. Services provided under a contract |
|
entered into before the effective date of this Act are governed by |
|
the law in effect on the date the contract was entered into, and the |
|
former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2023. |
