R E S O L U T I O N

|
BE IT RESOLVED by the House of Representatives of the State of |
|
|
Texas, 88th Legislature, Regular Session, 2023, That House Rule 13, |
|
|
Section 9(a), be suspended in part as provided by House Rule 13, |
|
|
Section 9(f), to enable the conference committee appointed to |
|
|
resolve the differences on Senate Bill 12 (the authority to |
|
|
regulate sexually oriented performances and to restricting those |
|
|
performances on the premises of a commercial enterprise, on public |
|
|
property, or in the presence of an individual younger than 18 years |
|
|
of age; authorizing a civil penalty; creating a criminal offense) |
|
|
to consider and take action on the following matter: |
|
|
House Rule 13, Section 9(a)(4), is suspended to permit the |
|
|
committee to add text on a matter not included in either the house |
|
|
or senate version of the bill in proposed SECTION 3 of the bill, by |
|
|
adding Section 43.28(a)(1)(E), Penal Code, to read as follows: |
|
|
(E) the exhibition of sexual gesticulations |
|
|
using accessories or prosthetics that exaggerate male or female |
|
|
sexual characteristics |
|
|
Explanation: The change is necessary to add additional |
|
|
conduct to the definition of sexual conduct. |
