A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to requiring public institutions of higher education to |
|
make available to students certain pregnancy-related informational |
|
materials published by the Department of State Health Services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|
amended by adding Section 51.9196 to read as follows: |
|
Sec. 51.9196. REQUIRED INFORMATION FOR STUDENTS RELATED TO |
|
PREGNANCY RESOURCES. (a) In this section: |
|
(1) "Institution of higher education" has the meaning |
|
assigned by Section 61.003. |
|
(2) "QR code" has the meaning assigned by Section |
|
443.001, Health and Safety Code. |
|
(b) The student health center of each institution of higher |
|
education shall: |
|
(1) make available at no cost to students the |
|
informational materials described by Section 171.014, Health and |
|
Safety Code, in a printed format; and |
|
(2) post in a conspicuous location at the student |
|
health center a sign containing a QR code that may be scanned and |
|
that leads to the Internet website described by Section 171.014(e), |
|
Health and Safety Code. |
|
(c) The executive commissioner of the Health and Human |
|
Services Commission by rule shall prescribe the design and content |
|
of the sign required to be posted under this section. |
|
SECTION 2. Not later than January 15, 2024, the executive |
|
commissioner of the Health and Human Services Commission shall |
|
adopt rules as required by Section 51.9196(c), Education Code, as |
|
added by this Act. |
|
SECTION 3. This Act applies beginning with the 2024 spring |
|
semester. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
