A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the exclusion of students not lawfully present in the |
|
|
United States from consideration for purposes of the indicators of |
|
|
achievement under the public school accountability system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.053, Education Code, is amended by |
|
|
adding Subsection (c-5) to read as follows: |
|
|
(c-5) A student not lawfully present in the United States |
|
|
may not be included in evaluating school district and campus |
|
|
performance on the achievement indicators adopted under Subsection |
|
|
(c) and may be considered only as necessary to comply with |
|
|
applicable federal accountability reporting requirements. |
|
|
SECTION 2. This Act applies beginning with the 2023-2024 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
