A BILL TO BE ENTITLED
 
AN ACT
  relating to an opioid-related drug overdose training program for
  certain alcoholic beverage permit holders.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 5, Alcoholic Beverage
  Code, is amended by adding Section 5.61 to read as follows:
         Sec. 5.61.  TRAINING PROGRAM ON OPIOID-RELATED DRUG
  OVERDOSE.  (a)  In this section, "opioid antagonist" and
  "opioid-related drug overdose" have the meanings assigned by
  Section 483.101, Health and Safety Code.
         (b)  The commission shall develop a training program that
  provides training on:
               (1)  the signs and symptoms of an opioid-related drug
  overdose; and
               (2)  the administration of an opioid antagonist.
         (c)  The commission may make the training available online.
         SECTION 2.  Chapter 28, Alcoholic Beverage Code, is amended
  by adding Section 28.20 to read as follows:
         Sec. 28.20.  TRAINING PROGRAM ON OPIOID-RELATED DRUG
  OVERDOSE.  (a)  Except as provided by Subsection (b), the holder of
  a mixed beverage permit and each employee of the permit holder who
  is required by the permit holder to complete a commission-approved
  seller training program shall complete the opioid-related drug
  overdose training program described by Section 5.61 each year.
         (b)  This section does not apply to a mixed beverage permit
  holder that is a restaurant as defined by Section 1.04.
         SECTION 3.  Chapter 32, Alcoholic Beverage Code, is amended
  by adding Section 32.26 to read as follows:
         Sec. 32.26.  TRAINING PROGRAM ON OPIOID-RELATED DRUG
  OVERDOSE.  (a)  Except as provided by Subsection (b), the holder of
  a private club registration permit and each employee of the permit
  holder who is required by the permit holder to complete a
  commission-approved seller training program shall complete the
  opioid-related drug overdose training program described by Section
  5.61 each year.
         (b)  This section does not apply to the holder of a private
  club registration permit that is a restaurant as defined by Section
  1.04.
         SECTION 4.  This Act takes effect September 1, 2023.
