A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to reporting by operators of certain gas supply chain |
|
facilities and gas pipeline facilities on a failure to perform a |
|
contractual obligation due to a weather emergency. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 86.044, Natural Resources Code, is |
|
amended by adding Subsection (g-1) to read as follows: |
|
(g-1) The commission by rule shall require each operator of |
|
a gas supply chain facility that fails to perform a contractual |
|
obligation related to the provision of natural gas in the |
|
electricity supply chain as mapped under Section 38.203, Utilities |
|
Code, due to force majeure during a weather emergency to report the |
|
failure and force majeure to the commission not later than the 60th |
|
day after the date of the failure. Information provided by an |
|
operator of a gas supply chain facility under this subsection is |
|
confidential and is not subject to disclosure under Chapter 552, |
|
Government Code, unless the requestor is a party to the contract. |
|
SECTION 2. Section 121.2015, Utilities Code, is amended by |
|
adding Subsection (e-1) to read as follows: |
|
(e-1) The railroad commission by rule shall require each gas |
|
pipeline facility operator described by Subsection (a)(3) that |
|
fails to perform a contractual obligation regarding the provision |
|
of gas in the electricity supply chain as mapped under Section |
|
38.203 due to force majeure during a weather emergency to report the |
|
failure and force majeure to the railroad commission not later than |
|
the 60th day after the date of the failure. Information provided by |
|
a gas pipeline facility operator under this subsection is |
|
confidential and is not subject to disclosure under Chapter 552, |
|
Government Code, unless the requestor is a party to the contract. |
|
SECTION 3. This Act takes effect September 1, 2023. |
