R E S O L U T I O N

|
BE IT RESOLVED by the Senate of the State of Texas, 88th |
|
|
Legislature, Regular Session, 2023, That Senate Rule 12.03 be |
|
|
suspended in part as provided by Senate Rule 12.08 to enable the |
|
|
conference committee appointed to resolve the differences on Senate |
|
|
Bill 28 (relating to financial assistance provided and programs |
|
|
administered by the Texas Water Development Board) to consider and |
|
|
take action on the following matters: |
|
|
(1) Senate Rule 12.03(2) is suspended to permit the |
|
|
committee to omit text not in disagreement in proposed SECTION 2 of |
|
|
the bill, by omitting text in added Section 15.153(a), Water Code. |
|
|
The omitted text reads: |
|
|
the acquisition or creation of |
|
|
Explanation: The change is necessary to limit the purposes |
|
|
for which money in the new water supply for Texas fund may be used. |
|
|
(2) Senate Rule 12.03(2) is suspended to permit the |
|
|
committee to omit text not in disagreement in proposed SECTION 2 of |
|
|
the bill, by omitting added Section 15.153(b)(1)(A), Water Code. |
|
|
The omitted text reads: |
|
|
(A) the acquisition of water from other states; |
|
|
Explanation: The change is necessary to limit the purposes |
|
|
for which money in the new water supply for Texas fund may be used. |
|
|
(3) Senate Rule 12.03(2) is suspended to permit the |
|
|
committee to omit text not in disagreement in proposed SECTION 2 of |
|
|
the bill, by omitting text in added Section 15.153(b)(3), Water |
|
|
Code. The omitted text reads: |
|
|
only for the acquisition or transfer of water originating outside |
|
|
this state |
|
|
Explanation: The change is necessary to limit the purposes |
|
|
for which money in the new water supply for Texas fund may be used. |
|
|
(4) Senate Rule 12.03(2) is suspended to permit the |
|
|
committee to omit text not in disagreement in proposed SECTION 6 of |
|
|
the bill, by omitting added Section 15.502(d), Water Code. The |
|
|
omitted text reads: |
|
|
(d) The comptroller may not use the fund for certification |
|
|
under Section 49a, Article III, Texas Constitution. |
|
|
Explanation: The change is necessary to clarify the purposes |
|
|
for which the Texas water fund may be used. |
