FROM:
Jerry McGinty, Director, Legislative Budget Board
IN RE:
HB381 by Thompson, Senfronia (Relating to the applicability of the death penalty to a capital offense committed by a person with an intellectual disability.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would prevent courts from imposing a death sentence on persons with an intellectual disability.
The Office of Capital and Forensic Writs anticipates undetermined cost savings to the state court system as a result of a reduction in capital murder cases where the death penalty is sought. The Office of Court Administration anticipates no significant fiscal impact to the state court system as a result of the change.
It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
