No significant fiscal implication to the State is anticipated.
This bill would amend the Government Code to require the Local Workforce Development Boards' representatives to comprise no less than 25 percent of individuals representing the local child care industry and have at least five years of industry experience. Additionally, local workforce boards would be required to publish information for parents and child care providers regarding various aspects of child care programs and to publish child care waitlist data/information quarterly. This bill would amend the Labor Code to add definitions, to require the Texas Workforce Commission (TWC) to develop written training and a timeline for implementing each rule change regarding child care programs, and develop performance measures for child care services via a community needs assessment. This bill would take effect September 1, 2023.
Based on the analysis of the TWC, any duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. This analysis assumes the TWC would be required to address issues and concerns which may arise from the annual community needs assessments, and the community needs assessment will primarily focus on activities related to improving the quality of care. TWC estimates that the annual cost would total $89,589,270 in federal Child Care Development Fund Mandatory funds, the Temporary and Needy Family (TANF) Title XX funds, and the Child Care Maintenance of Effort funds. As federal funds would not be increased for this purpose, the increase in quality improvement efforts to address the local community needs assessment could result in a direct reduction of services to children by approximately 10,500 in fiscal year 2024 and 10,100 in fiscal year 2025.
