Fiscal Analysis
This bill would amend the Government Code to modify the determination of service credit of certain judges and prosecutors for compensation purposes. For service credit of a statutory probate court judge or statutory county court judge, the bill would include years of service as a district attorney, criminal district attorney, or county attorney.
The bill would direct the state to compensate the administrative county of a multicounty statutory county court an amount equal to the state salary of a district judge with comparable years of service. The bill would include years of service as an appellate court, district court, statutory county court, statutory probate court justice or judge, a district attorney, criminal district attorney, or county attorney in the service determination of a multicounty statutory county court judge.
The bill would provide that years of service as a district attorney or criminal district attorney include any years of service as a district attorney, criminal district attorney, county attorney, an appellate court justice, district judge, statutory county court judge, multicounty statutory county court judge or statutory probate court justice or judge.
Methodology
The Office of Court Administration does not have information regarding which current judges or prosecutors have accrued the service the bill would require to be considered when calculating salaries. However, the Comptroller - Judiciary Section estimates that salary costs for judges and prosecutors would increase by $353,000 each fiscal year under the provisions of the bill.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
