LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

April 26, 2023

TO:
Honorable Jeff Leach, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB2770 by DeAyala (relating to exemption of certain civil actions from being subject to a motion to dismiss on the basis of involving the exercise of certain constitutional rights.), Committee Report 1st House, Substituted

The fiscal implications of the bill cannot be determined because the extent to which the exemption provided by the bill would impact the state court system is unknown.

The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

The bill would amend the Civil Practice and Remedies Code to exempt certain legal actions to enforce any provision of the Election Code, from the provisions of Chapter 27 of that Code. The bill provides that Chapter 27 does not apply to legal action brought under or to enforce a provision of the Election Code other than a provision of Title 15 of that Code.

Based on the analysis of the Office of Court Administration, the fiscal implications cannot be determined because the extent to which the exemption provided by the bill would impact the state court system is unknown.

Local Government Impact

The fiscal implications of the bill cannot be determined because the extent to which the exemption provided by the bill would impact the local court system is unknown.
