The fiscal implications of the bill cannot be determined because the number of cases and defendants with qualifying offenses impacted by the provisions of the bill are unknown.

The joint resolution would propose a constitutional amendment requiring the denial of bail for a period not to exceed 30 days to certain persons arrested for an offense resulting in the death of or serious bodily injury to a person younger than 18 years of age. The bill would also require that the person engaged in the described offense may not be denied bail more than once for the same offense. 

The cost to the state for publication of the resolution is $204,406.

According to analysis provided by the Office of Court Administration, the fiscal impact can not be determined because the number of cases and defendants with qualifying offenses impacted by the provisions of the bill are unknown.

Local Government Impact

The fiscal impact to units of local governments cannot be determined but would be dependent on the number of individuals detained for such an offense.
