The fiscal implications of the bill cannot be determined due to uncertainty around the potential increase in state supported living center admissions.

The bill would authorize a court to commit a proposed resident to a long-term placement in a residential care facility without an interdisciplinary team recommendation if the court determines beyond a reasonable doubt that the proposed resident meets certain requirements for commitment. The bill would authorize a parent or guardian of a proposed resident to petition a court to issue a commitment order.

According to the Health and Human Services Commission (HHSC), the fiscal implications of the bill cannot be determined because although the bill could result in an increase to state supported living center admissions, the amount of the increase is unknown. An increase in admissions to state supported living centers would result in a cost to HHSC.

Local Government Impact

No fiscal implication to units of local government is anticipated.
