No fiscal implication to the State is anticipated.

The bill would amend Government Code, Section 402.036, to rename GR Account 5154 - Choose Life Account as the Support Adoption Account. The bill would amend Transportation Code, Section 504.662, to rename the "Choose Life" specialty license plate, issued by the Texas Department of Motor Vehicles (TxDMV), as the "Support Adoption" specialty plate. The bill would amend Transportation Code, Chapter 521, to allow a person to make a voluntary contribution to the Support Adoption Account when applying for a new or renewal driver's license or personal identification certificate and require the Department of Public Safety (DPS) to provide a space on the application for a person to indicate the amount of the contribution. The bill would take effect on September 1, 2023.

Note: This legislation would do one or more of the following: create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either in, with, or outside the Treasury, or create a dedicated revenue source. The fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.

Based on the information provided by DPS and TxDMV, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the agencies' existing resources. 

The bill would recreate the GR Account 5154 - Choose Life Account, which is currently inactive, as the Support Adoption Account. Because the amount of voluntary contributions made by applicants for new or renewal driver's license and personal identification certificates is unknown, the potential revenue gain to the Support Adoption Account and fiscal impact to the State cannot be estimated. However, this analysis assumes implementation of bill would not result in a significant fiscal impact to the State.

Under current law, fees for issuance of the Choose Life specialty license plate (renamed Support Adoption under the provisions of the bill), after deduction of TxDMV's administrative costs, are deposited to Fund 0802 - License Plate Trust Fund. Based on the analysis of the Comptroller of Public Accounts, it is assumed provisions of the bill relating to the Support Adoption specialty license plate would have no fiscal impact on the state.

Local Government Impact

No fiscal implication to units of local government is anticipated.
