BACKGROUND AND PURPOSE

 

On December 29, 2022, the U.S. Congress changed the date for the meeting and vote of the electoral college from the first Monday after the second Wednesday in December following their appointment to the first Tuesday after the second Wednesday in December following their appointment. Since then, Texas law has been in conflict with that federal law. H.B. 2811 seeks to resolve this conflict by updating the Election Code to conform to changes in the federal code.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2811 amends the Election Code to change the date on which presidential electors are required to convene at the State Capitol to perform their duties as prescribed by federal law from the first Monday after the second Wednesday in December following their election to the first Tuesday after that Wednesday.

 

EFFECTIVE DATE

 

September 1, 2025.
