A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to law enforcement reports concerning certain arrest |
|
|
information of persons who are not lawfully present in the United |
|
|
States. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 2A, Code of Criminal |
|
|
Procedure, is amended by adding Article 2A.2061 to read as follows: |
|
|
Art. 2A.2061. LAW ENFORCEMENT AGENCIES: REPORT CONCERNING |
|
|
ARRESTS OF PERSONS NOT LAWFULLY PRESENT IN UNITED STATES. (a) Not |
|
|
later than January 31 of each year, each municipal police |
|
|
department and sheriff's department shall post on the department's |
|
|
Internet website a report on the number of criminal offenses |
|
|
committed in the county or municipality, as applicable, during the |
|
|
preceding calendar year for which a person arrested by the |
|
|
department is known by the department to not be lawfully present in |
|
|
the United States. |
|
|
(b) The report described by Subsection (a) must include, for |
|
|
each arrested person identified as not lawfully present: |
|
|
(1) each offense for which the person was arrested; |
|
|
and |
|
|
(2) the total number of offenses for which the person |
|
|
was arrested. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
