A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a tenant's provision of notice to a landlord for a |
|
|
repair or remedy through an online apartment portal. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 92.052(d), Property Code, is amended to |
|
|
read as follows: |
|
|
(d) The tenant's notice under Subsection (a): |
|
|
(1) must be in writing only if the tenant's lease is in |
|
|
writing and requires written notice; and |
|
|
(2) may be provided by the tenant to the landlord |
|
|
through an online apartment portal, if one is maintained by the |
|
|
landlord and rent is paid through the portal. |
|
|
SECTION 2. Section 92.052(d), Property Code, as amended by |
|
|
this Act, applies only to a lease agreement entered into or renewed |
|
|
on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
