A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the membership of a public school's threat assessment |
|
|
and safe supportive school team when conducting threat assessments |
|
|
of certain students. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 37.115, Education Code, is amended by |
|
|
adding Subsection (d-1) to read as follows: |
|
|
(d-1) Notwithstanding Subsection (d), if a student in a |
|
|
special education program under Subchapter A, Chapter 29, is the |
|
|
subject of a threat assessment under Subsection (f), the team |
|
|
conducting the threat assessment must include a member of the |
|
|
student's admission, review, and dismissal committee who has |
|
|
specific knowledge of the student's disability and special |
|
|
education services the student receives. |
|
|
SECTION 2. This Act applies beginning with the 2025-2026 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
