A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requiring each public institution of higher education |
|
|
to designate a Title VI coordinator. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|
|
amended by adding Section 51.9318 to read as follows: |
|
|
Sec. 51.9318. DESIGNATION OF TITLE VI COORDINATOR. (a) In |
|
|
this section, "institution of higher education" has the meaning |
|
|
assigned by Section 61.003. |
|
|
(b) Each institution of higher education shall designate an |
|
|
employee of the institution with expertise in Title VI, Civil |
|
|
Rights Act of 1964 (42 U.S.C. Section 2000d et seq.), to serve as a |
|
|
Title VI coordinator. |
|
|
(c) A Title VI coordinator designated under Subsection (b) |
|
|
shall: |
|
|
(1) oversee the institution's compliance with Title |
|
|
VI, Civil Rights Act of 1964 (42 U.S.C. Section 2000d et seq.); |
|
|
(2) promote equal access to and participation in the |
|
|
programs and activities of the institution of higher education; |
|
|
(3) provide training and educational resources |
|
|
regarding Title VI law; |
|
|
(4) document and investigate complaints alleging a |
|
|
violation of Title VI, Civil Rights Act of 1964 (42 U.S.C. Section |
|
|
2000d et seq.); |
|
|
(5) maintain records and reports regarding complaints |
|
|
received and investigations conducted under Subdivision (4); and |
|
|
(6) perform any other relevant duties established by |
|
|
the institution of higher education. |
|
|
SECTION 2. Section 51.9318, Education Code, as added by |
|
|
this Act, applies beginning with the 2025-2026 academic year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
