S.B. No. 1066
 
 
 
 
AN ACT
  relating to the requirement for performance and payment bonds from
  certain contractors of the Parks and Wildlife Department.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.0171, Parks and Wildlife Code, is
  amended by adding Subsection (a-1) to read as follows:
         (a-1)  If the value of a contract under Subsection (a)(2) for
  constructing, altering, or repairing a public building or carrying
  out or completing any public work exceeds $150,000, the department,
  the executive director, or the executive director's designee shall
  require the contractor to execute a performance bond and a payment
  bond to the department before beginning work.
         SECTION 2.  Section 11.0171(a-1), Parks and Wildlife Code,
  as added by this Act, applies only to a contract for which the Parks
  and Wildlife Department first advertises or otherwise requests
  bids, proposals, offers, or qualifications, or makes a similar
  solicitation, on or after the effective date of this Act. A
  contract for which the department first advertises or otherwise
  requests bids, proposals, offers, or qualifications, or makes a
  similar solicitation, before the effective date of this Act is
  governed by the law as it existed immediately before that date, and
  that law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2025.
