A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Commission on Environmental |
|
|
Quality to authorize the transfer of an authorization to use a |
|
|
standard permit for certain concrete facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|
|
Code, is amended by adding Section 382.070 to read as follows: |
|
|
Sec. 382.070. TRANSFER OF AUTHORIZATION TO USE STANDARD |
|
|
PERMIT FOR CERTAIN CONCRETE FACILITIES PROHIBITED. (a) |
|
|
Notwithstanding any other law, the commission may not authorize the |
|
|
transfer of an authorization to use a standard permit issued under |
|
|
Section 382.05195 or 382.05198 to a purchaser of the authorized |
|
|
facility if the facility is: |
|
|
(1) a concrete plant that performs wet batching, dry |
|
|
batching, or central mixing; or |
|
|
(2) a concrete crushing facility. |
|
|
(b) The commission shall require the person who purchased |
|
|
the facility to apply for a new authorization to use the applicable |
|
|
standard permit before operating the facility. |
|
|
(c) If the commission amended the applicable standard |
|
|
permit after the date the authorization was issued to the person who |
|
|
sold the facility, the amended standard permit applies to an |
|
|
application for an authorization to use the standard permit |
|
|
submitted by the person who purchased the facility. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
