LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

May 8, 2025

TO:
Honorable Ken King, Chair, House Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB256 by Leo Wilson (relating to the Department of Public Safety performing DNA testing of certain individuals crossing the Texas-Mexico border and restrictions on the use of the results of those tests.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would direct the Department of Public Safety (DPS) to enter in to an agreement with the United States Department of Homeland Security (DHS) to establish a DNA testing program for certain individuals. Under the provisions of the bill, DPS would not be required to establish or operate the program unless funding from DHS was sufficient to cover program costs.

According to DPS, any agreement with DHS to implement the provisions of this bill would require DHS to fund the program. Therefore, any cost to DPS associated with the bill could be absorbed using existing resources. Any cost to DHS will depend on the scope of the inter-agency agreement with DPS and cannot be determined at this time.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
