LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

March 17, 2025

TO:
Honorable John T. Smithee, Chair, House Committee on Criminal Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB799 by Moody (Relating to the release on personal bond of certain defendants charged with a misdemeanor or state jail felony.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require a magistrate to release certain defendants on personal bond unless the bond is prohibited by law or the magistrate makes certain findings.

According to the Office of Court Administration (OCA), no significant fiscal impact to the state court system is anticipated.

Local Government Impact

The fiscal impact to units of local government cannot be determined as the number of persons that would qualify for release on personal bond under the bill's provisions is unknown. However, jail operating costs could be reduced if fewer defendants remain in custody prior to trial.
