FROM:
Jerry McGinty, Director, Legislative Budget Board
IN RE:
HB2031 by Richardson (Relating to the possession, carrying, transporting, or storing of a firearm or firearm ammunition by a tenant on the leased premises; providing a civil penalty.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would impose a civil penalty on landlords who prohibit tenants or their guests from lawfully possessing, carrying, transporting, or storing a firearm. A tenant would be allowed to file a complaint with the Office of the Attorney General (OAG) if a violation occurs.
The OAG anticipates any legal work resulting from the passage of this bill could be reasonably absorbed utilizing existing resources.
No significant fiscal impact to the state court system is anticipated.
Any revenue impact would be dependent on the number of initial and subsequent violations that result in a civil penalty. Because of the unknown number of violations that may occur, the revenue impact of the bill cannot be determined.
Any civil penalties collected from the provisions of the bill would be deposited into the General Revenue-Dedicated Compensation to Victims of Crime Account 469.
Note: This legislation would do one or more of the following: create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either in, with, or outside the Treasury, or create a dedicated revenue source. The fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
