Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

May 5, 2025

TO:
Honorable Pete Flores, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB2917 by Miles (Relating to the penalties for certain littering offenses.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would create new criminal penalties for the offense related to illegal dumping ranging from a Class C misdemeanor to a Class A misdemeanor with potential fines between $2,000 to $50,000 and allow for potential enhancement as well as reimbursement to counties or municipalities dependent on certain conditions and previous convictions.

It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant

Local Government Impact

While it is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant, the provisions of the bill may result in increased local revenue from the reimbursements collected.
