House Bill 1540 amends the Health and Safety Code and Occupations Code to continue the Texas Funeral Service Commission (TFSC) until September 1, 2031, to discontinue TFSC regulation of non-perpetual care cemeteries, and to provide for certain across‑the‑board sunset provisions. Among other provisions, including provisions governing the pickup and transfer of a dead human body, the bill reduces the frequency of required inspections of a licensed crematory or funeral establishment, revises and updates provisions relating to an application by an out‑of‑state holder of a funeral director's license or an embalmer's license and to a duplicate license, repeals certain provisions relating to provisional licenses, authorizes the TFSC to determine the criteria by which a funeral establishment is exempt from the requirement to have a preparation room for embalming services, and changes certain TFSC reporting requirements regarding its activities. The bill's provisions take effect September 1, 2019, but the provision changing the TFSC reporting requirements takes effect September 1, 2020.
