            House Bill 1751 amends the Business & Commerce Code to impose a fee on certain sexually-oriented businesses in an amount equal to $5 for each time a customer enters the business.  The bill sets out provisions relating to the administration, payment, collection, and enforcement of the fee by the comptroller.  The bill requires the comptroller to deposit the first $25 million received from the fee in a state fiscal biennium to the credit of the sexual assault program fund and specifies the uses for which the fund may be appropriated.  The bill requires the comptroller to deposit any excess revenue to the credit of the Texas health opportunity pool.  House Bill 1751 establishes the Sexual Assault Advisory Council and sets out its mission.  The bill authorizes the legislature to appropriate funds for a third-party assessment of the sexually‑oriented business industry in Texas, including recommendations on how to further regulate the growth of the industry.
