House Bill 1791 amends the Civil Practice and Remedies Code to limit the liability of a space flight entity, including a political subdivision or spaceport corporation as specified by the bill, for damages resulting from any claim for nuisance arising from certain space flight activities. The bill specifies that its provisions relating to the limited liability of a space flight entity preclude injunctive relief and do not limit liability for breach of a contract or preclude a governmental action as specified by the bill. The bill clarifies that the signature of a space flight participant on the required agreement prior to space flight is on behalf of certain others, including any heirs of the participant. The bill amends Local Government Code and Government Code provisions relating to spaceport development corporations and the spaceport trust fund, respectively, to provide for the use of a spacecraft, as defined by the bill, and it amends the Penal Code to establish that noise arising from lawful space flight activities does not constitute unreasonable noise for purposes of the disorderly conduct law.
