House Bill 1985 amends the Texas Probate Code to provide that a guardian ad litem appointed to represent the interests of an incapacitated person in certain guardianship proceedings is not liable for civil damages arising from a recommendation made or an opinion given in the capacity of guardian ad litem; however the immunity does not apply to a recommendation or opinion that is wilfully wrongful, given with conscious indifference or reckless disregard to the safety of another, given in bad faith or with malice, or grossly negligent.
