House Bill 2053 amends Family Code, Code of Criminal Procedure, and Occupations Code provisions relating to the child safety check alert list maintained by the Department of Public Safety (DPS) as part of the Texas Crime Information Center. The bill establishes the circumstances under which the Department of Family and Protective Services (DFPS) must notify DPS concerning an abused or neglected child who is missing or the child's family, removes the requirement that DFPS pursue certain legal action before the child or the child's family may be placed on the alert list, and revises the information that must be included in the alert list. The bill revises the duties of a law enforcement officer who encounters a child or other person on the alert list and the procedure for removing a child from the alert list and provides for an education and training program on the alert list established by the Texas Commission on Law Enforcement. Effective March 1, 2016, the bill provides for a DPS report on the use of the alert list. Otherwise, the bill takes effect September 1, 2015.
