House Bill 2590 amends the Human Resources Code to revise the circumstances under which the Health and Human Services Commission (HHSC) is required to give a provider who participates in the home and community-based services waiver program or the Texas home living waiver program time to correct a violation of a law or rule relating to the program before HHSC may assess an administrative penalty. The bill also provides for an amelioration process for a participating provider who is subject to such an administrative penalty and an informal dispute resolution process for disputes relating to a proposed enforcement action or related proceeding of HHSC against a participating provider.
