House Bill 3040 amends the Health and Safety Code to prohibit the Texas Natural Resource Conservation Commission from requiring or considering air dispersion modeling results predicting ambient concentrations of noncriteria pollutants over coastal waters of the state in its consideration or review of a permit for a shipyard. The bill requires the commission to determine compliance with noncriteria ambient air pollutant standards and guidelines according to the land-based off-property concentrations of air contaminants in its consideration or review.
