House Bill 988 amends the Transportation Code to require a person who sells a motor vehicle and applies for the vehicle's registration or certificate of title on behalf of the purchaser to apply, as directed by the purchaser, to the county assessor-collector in the county in which the purchaser is domiciled or the vehicle is purchased or encumbered. The bill requires the Texas Department of Transportation to promulgate a form for designating the purchaser's choice of counties, and it requires the seller to make the form available at the time of purchase. It provides that a seller has a reasonable time period to obtain and file documents necessary to transfer title or register the vehicle and is not in violation of that requirement while making a good faith effort to comply. The bill does not affect the passage of equitable title to the purchaser at the time of an enforceable sale.
