House Joint Resolution 53 proposes a constitutional amendment to authorize the legislature to release all or part of the state's interest in land, excluding mineral rights, if the land is surveyed, unsold permanent school fund land, the land is not patentable under the law in effect before January 1, 2002, and the person claiming title to the land acquired the land not knowing that title was vested in the state, has a properly recorded deed, and has paid and is current on all property taxes due on the land. The amendment does not apply to certain state-owned land such as beach land and submerged land islands, or land determined to be stated-owned by judicial decree.
