            Senate Bill 1283 amends the Government Code to prohibit the executive commissioner of the Health and Human Services Commission (HHSC), in the rules and standards governing the Medicaid vendor drug program, from requiring a clinical, nonpreferred, or other prior authorization for an antiretroviral drug, or a step therapy or other protocol, that could restrict or delay the dispensing of the drug except to minimize fraud, waste, or abuse. The bill makes the same prohibition applicable to an outpatient pharmacy benefit plan developed, implemented, and maintained by a managed care organization under contract with HHSC.
