Current law establishes that recklessness and danger are presumed in the commission of the offense of deadly conduct if the actor knowingly pointed a firearm at or in the direction of another. Senate Bill 1637 amends the Penal Code to establish that this presumption does not apply to a peace officer engaged in the lawful discharge of the officer's official duties. The bill also exempts a peace officer engaged in the actual discharge of those duties from the application of certain conduct constituting that offense under certain circumstances.
