Effective: 9-1-09 |
House Sponsor: Brown, Fred |
Senate Bill 1930 amends the Civil Practice and Remedies Code to require a court in a civil action against a defendant in which a plaintiff, as defined by the bill, seeks recovery of damages or other relief based on the sexual abuse of a minor to inform the plaintiff as early as possible in the proceedings that the plaintiff may use a confidential identity in that civil action; to allow the plaintiff to use a confidential identity in all petitions, filings, and other documents presented to the court; and to use the confidential identity in all of the court's proceedings and records relating to the action. The bill entitles only certain persons in such a civil action to know the true identifying information about the plaintiff and requires the court to prohibit such a person from divulging the information to anyone without a written order of the court. The bill prohibits the supreme court from amending or adopting rules in conflict with these provisions.
