Senate Bill 20 amends the Penal Code to create the state jail felony offense of possession, promotion, or production of certain visual material appearing to depict a child for a person who does the following:

The bill enhances the penalty for the offense, ranging from a third degree felony to a second degree felony, based on the number of previous convictions of the person for such an offense or for obscenity, possession or promotion of child pornography, electronic transmission of certain visual material depicting a minor, or possession or promotion of lewd visual material depicting a child. The bill expands the conduct constituting the offense of engaging in organized criminal activity to include any possession, promotion, or production of certain visual material appearing to depict a child offense with the intent to establish, maintain, or participate in a combination or in the profits of a combination or as a member of a criminal street gang or foreign terrorist organization.
