            Under current law, a guardianship program operated by a county with a population of more than 2.5 million is exempt from provisions that require the guardian of a person or estate to post a bond. Senate Bill 318 amends the Texas Probate Code to extend this exemption to a guardianship program operated by any county. The act specifies certain types of bonds that a court is authorized to accept from the guardian of the person of a ward and requires the court to make certain considerations in determining the type and amount of bond required.

            In addition, Senate Bill 318 amends the Civil Practice and Remedies Code to make a local government liable for damages awarded against an employee that result from the employee's appointment as guardian.
