Current law prohibits a property owners' association from enforcing or adopting a restrictive covenant that prohibits the display of a religious item on the entry to an owner's or resident's dwelling, with certain exceptions. Senate Bill 581 amends the Property Code to expand the scope of that law by prohibiting the enforcement or adoption of a provision in a dedicatory instrument, including a restrictive covenant, that prohibits the display of a religious item anywhere on an owner's or resident's property or dwelling. The bill also revises the exceptions to the prohibition and repeals a provision authorizing a property owners' association to remove religious items displayed in violation of a restrictive covenant.
