Senate Bill 662

Senate Author:  Nichols et al.

Effective:  9-1-11

House Sponsor:  Anchia

Senate Bill 662 amends provisions of the Occupations Code relating to the continuation and functions of the State Board of Examiners for Speech-Language Pathology and Audiology.  The bill continues the board until September 1, 2017,  amends and adds various standard
across-the-board sunset provisions, and establishes criminal history record information requirements for the issuance or renewal of a license to practice speech-language pathology or audiology. The bill requires the board and the State Committee of Examiners in the Fitting and Dispensing of Hearing Instruments, with the assistance of the Department of State Health Services, to jointly adopt rules to establish requirements for each sale of a hearing instrument and authorizes the board to order an audiologist to pay a refund to a consumer who returns a hearing instrument during a specified trial period. The bill provides for the recusal of a board member who participated in the investigation of a complaint or in informal settlement negotiations regarding the complaint, with respect to voting on the matter
at a board meeting, authorizes the board to issue a cease and desist order prohibiting an unlicensed person in violation of state law or a rule relating to the practice of speech-language pathology or audiology from engaging in the apparent unlawful activity, and makes a violation of such an order grounds for imposing an administrative penalty.
