Effective: 6-15-07 |

Senate Bill 759 amends Family Code provisions relating to requirements for permanency hearings and placement review hearings for children under the care of the Department of Family and Protective Services. The bill directs the court to consult with a child in a developmentally appropriate manner regarding the child's permanency plan if the child is four years of age or older and the court determines it is in the best interest of the child. Senate Bill 759 entitles certain stakeholders to present evidence and be heard at a placement review hearing for a child under the department's care. The bill also provides that the licensed administrator of the child-placing agency responsible for placing a child is entitled to notice of a placement review hearing and requires that the child attend the hearing except in certain circumstances.
