Senate Bill 789 amends the Family Code to authorize a court to render a protective order sufficient to protect the applicant and members of the applicant's family or household that is effective for a period that exceeds two years in certain cases involving serious bodily injury or repeat acts of family violence and to authorize a person who is the subject of such a protective order to file by a specified date a subsequent motion requesting that the court review the protective order and determine whether there is a continuing need for the order. The bill clarifies that a protective order remains in effect until the order's expiration date if a court reviewing the order does not make a finding that there is no continuing need for the order and clarifies that evidence of the movant's compliance with the order does not by itself support a finding that there is no continuing need for the order.
